Know the Law
What a consumer complaint actually requires
Four elements must be established for a consumer dispute to become a criminal offence. We assess every incoming matter against each one before advising on strategy.
The offence arises when a cheque, issued to discharge a legally enforceable debt or liability, is returned unpaid by the bank — typically for insufficient funds or because the amount exceeds an arrangement with the bank. In the Consumer Commission jurisdiction, this frequently involves corporate service agreements, B2B settlements from Connaught Place and South Delhi, and high-value commercial transactions.
The consumer must present the cheque within its validity period — three months from the date on the cheque — issue a written demand within limitation period of the dishonour memo, and the opposite party must fail to pay within response period of receiving that notice. Only then does the cause of action to prosecute arise; see the full step-by-step procedure below.
The key considerations
- Consumer relationship and transaction — the cheque must relate to a real liability, not a gift, security-only instrument, or time-barred debt.
- Defect, deficiency or unfair trade practice — the cheque must be presented to the bank within three months of its date, or before it expires.
- Evidence and supporting documents — a written demand within limitation period of the dishonour memo, correctly addressed and provably delivered. See our notice drafting service.
- Failure to pay within response period — the complaint can only be filed after this cure period lapses without payment, as set out under Consumer Protection Act.
