The Practice
Filed where it matters — the Supreme Court itself
A transfer petition is filed directly before the Supreme Court of India, not the High Court or trial court where the original case is pending. What a transfer petition actually does
It is one of the most misunderstood filings in Indian litigation — often confused with an appeal or a Special Leave Petition. It is neither.
A transfer petition does not ask the Supreme Court to decide who is right in the underlying dispute. It asks the Court to decide where that dispute should be heard. The case itself — its facts, evidence, and eventual outcome — continues to be decided by the court it is transferred to, not by the Supreme Court.
The power comes from three sources: Article 139A of the Constitution (allowing the Supreme Court to transfer or withdraw cases raising the same questions of law pending across different High Courts), Section 25 of the Code of Civil Procedure, 1908 (civil suits, appeals and proceedings), and Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 — the provision that replaced Section 406 of the CrPC when the BNSS came into force on 1 July 2024 — for criminal cases and appeals.
What it is not
- Not an appeal — it doesn't challenge a judgment or order on its merits.
- Not a Special Leave Petition — an SLP asks the Supreme Court to hear the case itself; a transfer petition asks it to move the case elsewhere.
- Not for intra-state transfers — moving a case between two courts in the same state is ordinarily a matter for the jurisdictional High Court, not the Supreme Court.
- Not granted for mere inconvenience — courts have repeatedly held that distance or language difference alone is usually not enough; a specific, provable hardship or fair-trial concern is needed.

The Procedure
From drafting to final disposal
A transfer petition follows its own procedure, separate from the case it seeks to move.
Drafting & filing
The transfer petition is drafted with a supporting affidavit setting out the specific grounds, and filed directly before the Supreme Court along with the required documents from the original case.
Interim stay application
A separate application requesting a stay of proceedings in the original court is usually filed alongside the petition, so the case doesn't move forward while the transfer is pending.
Notice to the respondent
The Court issues notice to the other side, who is given an opportunity to file a reply or counter-affidavit opposing the transfer.
Mediation reference (matrimonial matters)
In many matrimonial transfer petitions, the Court refers the parties to its mediation centre to explore an amicable settlement before proceeding further.
Hearing
If not settled, the petition is listed for hearing, where both sides argue whether transfer is expedient for the ends of justice.
Final order
The Court either allows the petition — directing the case to a specified court — or dismisses it, in which case the original proceedings continue as before.

What usually doesn't succeed on its own
- Distance alone — courts have held that inconvenience of travel, by itself, is rarely sufficient.
- Language difference alone — noted by courts as an insufficient standalone ground in several rulings.
- General allegations — vague claims of bias or unfairness, without specific supporting facts.
In matrimonial matters specifically, courts have tended to give more weight to a wife's convenience even where the grounds are closer to hardship than outright unfairness — but this is not automatic, and every petition still turns on its own facts.
