Order 37 · Code of Civil Procedure, 1908

Recovery Suit Lawyer in Ghaziabad — Order 37 CPC summary suits, for debts a cheque case can't reach.

Not every unpaid debt involves a bounced cheque. Where the claim rests on a written contract, a guarantee, or a negotiable instrument, an Order 37 summary suit can secure a decree far faster than an ordinary civil suit. Veeraya Legal's Ghaziabad office is in Rajnagar Extension — the same immediate area as the Ghaziabad District Court itself.

How we work

  1. Fit assessed first — Order 37 only applies to specific categories of claim; we confirm this before drafting, not after filing.
  2. Genuinely local — our Ghaziabad office is in the same immediate area as the District Court, not a Delhi office claiming to cover UP.
  3. Documentation-led — the written contract, invoice, or instrument usually decides these cases before a single hearing happens.
  4. Both sides represented — pursuing recovery for a plaintiff, or building a leave-to-defend application for a defendant facing one.

The Practice

A recovery suit practice, based right here in Ghaziabad

Ghaziabad is its own jurisdiction — a different state, a different District Court, and appeals that go to the Allahabad High Court rather than Delhi's. Veeraya Legal maintains an office in Rajnagar Extension, in the same immediate area as the Ghaziabad District Court at Raj Nagar, and handles recovery suits directly here rather than coordinating them from across the state border.

Ghaziabad's industrial and commercial belt — Sahibabad, Vijay Nagar, and Kaushambi — generates a steady pattern of unpaid trade and supplier dues, well suited to Order 37 where the debt is backed by a written contract or invoice. Where a cheque is involved instead, see our Delhi recovery suit and cheque bounce pages for the Delhi-side practice.

  • Leave to defend applications, both sides
  • Trade & supplier dues — Sahibabad, Vijay Nagar, Kaushambi

Know the Law

What makes a summary suit different

Order 37 is a central law — the mechanics are identical whether the suit is filed in Ghaziabad or Delhi. What changes here is the court, not the procedure.

In an ordinary suit, a defendant simply files a written statement and the matter proceeds to trial. Under Order 37 of the CPC, that right doesn't exist by default. A defendant must first enter appearance within 10 days of being served — failing which, the plaintiff is entitled to a decree straightaway. Even after appearing, the defendant must then apply for leave to defend within 10 days of receiving the summons for judgment, by affidavit, setting out an actual defence.

Whether that leave is granted depends on how genuine the defence looks. Following the Supreme Court's guidance in IDBI Trusteeship Services Ltd v. Hubtown Ltd (2016): a defendant with a substantial, bona fide defence is generally granted leave without conditions. One with a plausible but doubtful defence may be granted leave only on depositing part of the claimed amount or furnishing security. And a defendant whose defence is sham or illusory can be refused leave entirely, meaning judgment is entered against them immediately.

What Order 37 actually covers

  1. Negotiable instruments — cheques, bills of exchange, promissory notes.
  2. Written contracts — for a fixed, liquidated sum of money.
  3. Guarantees — where the underlying claim against the principal debtor is itself a debt or liquidated demand.
  4. Not covered — unliquidated damages, or claims resting only on an oral agreement.

The Procedure

How an Order 37 suit proceeds

Every deadline here is strict — a missed step by either side can decide the case outright.

1

Plaint filed & summons issued

The suit is instituted before the Ghaziabad District Court with a specific Order 37 endorsement, supported by the written contract, invoice, or instrument.

2

Defendant enters appearance

The defendant must enter appearance or lose the right to defend entirely.

Within 10 days of summons
3

Summons for judgment served

Once appearance is entered, the plaintiff serves a summons for judgment, starting the clock on the defendant's next deadline.

4

Leave to defend applied for

The defendant must apply by affidavit, setting out a genuine defence — this single document usually decides the case's direction.

Within 10 days of summons for judgment
5

Leave granted, conditional, or refused

The court decides based on how genuine the defence appears — unconditional leave, leave on deposit/security, or refusal and immediate decree.

6

Trial, or decree & execution

Where leave is granted, the suit proceeds like an ordinary trial. Where it isn't, the decree is entered and execution can begin.

Frequently Asked

Questions we hear most often

What is a summary suit under Order 37 CPC?+
A summary suit is a faster civil recovery procedure available for specific categories of claims — debts based on negotiable instruments like cheques, written contracts for a fixed sum, or guarantees for such debts. This is a central law and applies the same way in Ghaziabad as anywhere else in India. See our full explainer above.
Which court hears recovery suits for Ghaziabad businesses?+
Recovery suits connected to Ghaziabad are ordinarily filed before the Ghaziabad District Court, located at Raj Nagar. Appeals and revisions go to the Allahabad High Court, which is different from the Delhi High Court that hears appeals from Delhi's district courts. See our Ghaziabad coverage above.
What happens if the defendant doesn't respond to an Order 37 suit?+
If the defendant fails to enter appearance within 10 days of service of summons, the allegations in the plaint are treated as admitted and the plaintiff is entitled to a decree. If the defendant appears but fails to apply for leave to defend within 10 days of the summons for judgment, the same result follows.
Can a defendant always get permission to contest an Order 37 suit?+
No. Following the Supreme Court's guidance in IDBI Trusteeship Services Ltd v. Hubtown Ltd (2016), a defendant with a substantial, bona fide defence is generally granted unconditional leave. One with a plausible but doubtful defence may be granted leave only on conditions, such as depositing part of the claim. A defendant with no real defence can be refused leave entirely.
Does Order 37 cover unpaid dues between businesses in Sahibabad or Vijay Nagar?+
Where the debt is backed by a written contract, invoice acknowledged in writing, or a cheque, yes. Order 37 is well suited to trade and supplier disputes common in Ghaziabad's industrial areas, provided the claim is for a fixed, liquidated sum and supported by a written instrument.
