How we work

  1. Evidence reviewed from day one — the transaction, invoice, agreement, warranty and correspondence are assessed at the start.
  2. Right forum, confirmed early — the appropriate Consumer Commission and applicable jurisdiction are identified before filing.
  3. Direct communication — you receive updates from the legal team handling your consumer matter.
  4. Both sides represented — equally comfortable acting for the consumer seeking recovery or the opposite party contesting a notice.

The Practice

Know the Law

What Consumer Protection Act, 2019 actually requires

Four elements must be established for a consumer dispute to become a criminal offence. We assess every incoming matter against each one before advising on strategy.

The offence arises when a cheque, issued to discharge a legally enforceable debt or liability, is returned unpaid by the bank — typically for insufficient funds or because the amount exceeds an arrangement with the bank. In the Ghaziabad Consumer Commission jurisdiction, this frequently involves corporate service agreements, B2B settlements from Raj Nagar and Raj Nagar Extension, and high-value commercial transactions.

The consumer must present the cheque within its validity period — three months from the date on the cheque — issue a written demand within 30 days of the supporting documents, and the opposite party must fail to pay within 15 days of receiving that notice. Only then does the cause of action to prosecute arise; see the full step-by-step procedure below.

30 Days
To send notice
15 Days
Drawer's cure period
1 Month
To file complaint after cure period lapses

The four ingredients

  1. A legally enforceable debt — the cheque must relate to a real liability, not a gift, security-only instrument, or time-barred debt.
  2. Presentation within validity — the cheque must be presented to the bank within three months of its date, or before it expires.
  3. Valid statutory notice — a written demand within 30 days of the supporting documents, correctly addressed and provably delivered. See our notice drafting service.
  4. Failure to pay within 15 days — the complaint can only be filed after this cure period lapses without payment, as set out under Section 142 of the Act.

Frequently Asked

Questions we hear most often

What does a Consumer Court Lawyer in Ghaziabad handle?+
Consumer matters commonly include defective goods, deficient services, unfair trade practices, delayed delivery, warranty disputes, refund or replacement claims and compensation.
Can I file a consumer complaint for a defective product?+
A complaint may be maintainable where the facts establish a consumer relationship and a legally recognised defect or deficiency. Invoices, warranty documents, correspondence, photographs and other supporting records can be important.
Which Consumer Commission should I approach for a Ghaziabad matter?+
The appropriate Consumer Commission depends on the applicable jurisdictional rules and the facts of the dispute. We assess the forum before filing.
Can a consumer dispute be settled without a full hearing?+
Yes. Depending on the matter, parties may explore negotiation, mediation or other settlement mechanisms. A settlement can sometimes resolve the dispute more efficiently than contested proceedings.
What documents should I bring for a consumer complaint?+
