What is the difference between a mutual consent divorce and a contested divorce?

A contested divorce is filed by one spouse on specific legal grounds (such as cruelty, adultery, or desertion) when the other spouse does not agree to a divorce or the terms.

How is maintenance or alimony calculated by the Family Court?

There is no fixed statutory formula for alimony in India. Courts determine maintenance based on various factors, including the income and properties of both spouses, their standard of living during the marriage, financial liabilities, and the financial and educational needs of the dependent spouse and children.

What is the cooling-off period in a mutual consent divorce?

Under the Hindu Marriage Act, after the First Motion is filed, there is a statutory cooling-off period of 6 months before the Second Motion can be filed. However, based on recent Supreme Court guidelines, this period can be waived by the Family Court in certain circumstances if all efforts at mediation have failed and the parties have genuinely settled all differences.
