Order 37 · Code of Civil Procedure, 1908
Recovery Suit Lawyer in Ghaziabad — Order 37 CPC summary suits, for debts a cheque case can't reach.
Not every unpaid debt involves a bounced cheque. Where the claim rests on a written contract, a guarantee, or a negotiable instrument, an Order 37 summary suit can secure a decree far faster than an ordinary civil suit. Veeraya Legal's Ghaziabad office is in Rajnagar Extension — the same immediate area as the Ghaziabad District Court itself.
Summary Suits
How we work
- Fit assessed first — Order 37 only applies to specific categories of claim; we confirm this before drafting, not after filing.
- Genuinely local — our Ghaziabad office is in the same immediate area as the District Court, not a Delhi office claiming to cover UP.
- Documentation-led — the written contract, invoice, or instrument usually decides these cases before a single hearing happens.
- Both sides represented — pursuing recovery for a plaintiff, or building a leave-to-defend application for a defendant facing one.
The Practice
A recovery suit practice, based right here in Ghaziabad
Ghaziabad is its own jurisdiction — a different state, a different District Court, and appeals that go to the Allahabad High Court rather than Delhi's. Veeraya Legal maintains an office in Rajnagar Extension, in the same immediate area as the Ghaziabad District Court at Raj Nagar, and handles recovery suits directly here rather than coordinating them from across the state border.
Ghaziabad's industrial and commercial belt — Sahibabad, Vijay Nagar, and Kaushambi — generates a steady pattern of unpaid trade and supplier dues, well suited to Order 37 where the debt is backed by a written contract or invoice. Where a cheque is involved instead, see our Delhi recovery suit and cheque bounce pages for the Delhi-side practice.
- Summary suits before the Ghaziabad District Court
- Leave to defend applications, both sides
- Trade & supplier dues — Sahibabad, Vijay Nagar, Kaushambi
- Consultations in Hindi & English
Know the Law
What makes a summary suit different
Order 37 is a central law — the mechanics are identical whether the suit is filed in Ghaziabad or Delhi. What changes here is the court, not the procedure.
In an ordinary suit, a defendant simply files a written statement and the matter proceeds to trial. Under Order 37 of the CPC, that right doesn't exist by default. A defendant must first enter appearance within 10 days of being served — failing which, the plaintiff is entitled to a decree straightaway. Even after appearing, the defendant must then apply for leave to defend within 10 days of receiving the summons for judgment, by affidavit, setting out an actual defence.
Whether that leave is granted depends on how genuine the defence looks. Following the Supreme Court's guidance in IDBI Trusteeship Services Ltd v. Hubtown Ltd (2016): a defendant with a substantial, bona fide defence is generally granted leave without conditions. One with a plausible but doubtful defence may be granted leave only on depositing part of the claimed amount or furnishing security. And a defendant whose defence is sham or illusory can be refused leave entirely, meaning judgment is entered against them immediately.
What Order 37 actually covers
- Negotiable instruments — cheques, bills of exchange, promissory notes.
- Written contracts — for a fixed, liquidated sum of money.
- Guarantees — where the underlying claim against the principal debtor is itself a debt or liquidated demand.
- Not covered — unliquidated damages, or claims resting only on an oral agreement.

How an Order 37 suit proceeds
Every deadline here is strict — a missed step by either side can decide the case outright.

The suit is instituted before the Ghaziabad District Court with a specific Order 37 endorsement, supported by the written contract, invoice, or instrument.
Defendant enters appearance
The defendant must enter appearance or lose the right to defend entirely.
Within 10 days of summonsSummons for judgment served
Once appearance is entered, the plaintiff serves a summons for judgment, starting the clock on the defendant's next deadline.

The defendant must apply by affidavit, setting out a genuine defence — this single document usually decides the case's direction.
Within 10 days of summons for judgmentLeave granted, conditional, or refused
The court decides based on how genuine the defence appears — unconditional leave, leave on deposit/security, or refusal and immediate decree.
Trial, or decree & execution
